Terms of Use
Last Updated: October 21, 2026
These Terms of Use (the “Terms”) govern your access to and use of Athletes World, including its website, articles, publications, digital content, paid access, features, services, and related offerings (collectively, the “Services”).
Athletes World is a digital publication published and operated by Burbayne Inc.. References in these Terms to “Athletes World,” “we,” “us,” or “our” refer to Burbayne Inc. in connection with its operation of the Athletes World publication and Services.
By accessing or using the Services, purchasing access, purchasing a feature or other service, or otherwise interacting with the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
1. Eligibility
You must be at least 13 years old to submit an application, participate in an eligible feature or opportunity, or otherwise provide personal information through the Services.
If you are under 18 years old, participation in an application, interview, profile, feature, submission, or other publication-related opportunity requires authorization from a parent or legal guardian.
You must be at least 18 years old and legally capable of entering into a binding agreement to independently purchase a paid Service. If you are under 18, any purchase, contract, release, or other transaction requiring legal capacity must be completed or authorized by a parent or legal guardian where required by applicable law.
2. Magazine and Editorial Services
Athletes World is an independent digital publication. The Services may include articles, photographs, interviews, editorials, news, sports coverage, athlete profiles, training, nutrition, fitness, lifestyle and athletics-related content, product recommendations, advertising, sponsored content, paid features, affiliate links, and other editorial or commercial material.
We may determine, modify, expand, reduce, reorganize, discontinue, replace, or otherwise change the subjects, categories, format, frequency, design, editorial direction, contributors, functionality, and content of the publication at any time.
Publication schedules are not guaranteed. Nothing in these Terms requires us to publish a particular number of articles, issues, stories, photographs, videos, interviews, or other pieces of content during any particular period.
3. Lifetime Access
We may offer a one-time purchase described as “Lifetime Access” or using similar terminology.
Lifetime Access means access to the applicable Athletes World digital publication for as long as that publication and the applicable access service continue to be operated and made available by us. Lifetime Access does not mean access for the biological lifetime of the purchaser, nor does it guarantee that Athletes World, Burbayne Inc., the website, any particular technology, or any particular content will exist or continue operating indefinitely.
Unless expressly stated otherwise at the time of purchase, Lifetime Access applies only to Athletes World. It does not provide access to other magazines, publications, products, platforms, memberships, services, or properties operated by Burbayne Inc. or its affiliates.
Lifetime Access is a limited personal access right and does not transfer ownership of any magazine content or intellectual property to you.
We may change the technology, website, domain name, authentication system, delivery method, format, or platform through which Lifetime Access is provided, provided that we may continue to make the applicable access available through a reasonably determined replacement method.
4. Email-Based Access
Paid access may be associated with the email address supplied at the time of purchase. Instead of requiring a password, we may provide access through secure email links, automatic authentication links, cookies, tokens, or similar technology.
You are responsible for maintaining control of and access to the email account associated with your purchase.
Authentication links and access credentials are personal to you. You may not intentionally distribute, publish, sell, sublicense, commercially exploit, or make them publicly available.
If you lose access to your email address, we may require reasonable information to verify your identity and purchase before changing the email address associated with your access.
We may invalidate authentication links, tokens, sessions, or other credentials and issue replacements when reasonably necessary for security, fraud prevention, technical maintenance, or protection of the Services.
5. Personal and Non-Transferable Access
Unless we expressly state otherwise, paid access is licensed to one individual for personal, non-commercial use.
You may not sell, rent, sublicense, transfer, share commercially, or otherwise provide your paid access to another person or organization.
We may restrict or suspend access when we reasonably believe access credentials have been publicly distributed, resold, obtained fraudulently, or used in a manner materially inconsistent with these Terms.
6. Prices, Currency and Taxes
Prices are those displayed at the time of purchase and may change for future purchasers at any time.
Changing the price of Lifetime Access after your completed purchase does not entitle you to a refund or price adjustment.
Prices may be displayed in Canadian dollars, U.S. dollars, or another currency as indicated during checkout.
You are responsible for applicable taxes, duties, currency-conversion charges, payment-provider charges, or other governmental or financial charges associated with your transaction, except to the extent such amounts are required to be collected and remitted directly by us.
7. Payment
Payments may be processed by third-party payment processors. By submitting payment information, you authorize the applicable charge and represent that you are authorized to use the payment method supplied.
We do not necessarily receive or store your complete payment-card information. Payment information may be collected and processed directly by our payment-processing providers under their own terms and privacy practices.
A transaction may be declined, cancelled, or reviewed when reasonably necessary to address suspected fraud, unauthorized payment activity, technical errors, sanctions compliance, or other legal or security concerns.
8. Refund Policy
Except where otherwise required by applicable law, purchases of Lifetime Access are final and non-refundable once purchased.
Because Lifetime Access provides access to digital content and services that may become available immediately following purchase, you acknowledge that access may begin immediately.
Nothing in these Terms excludes, limits, or waives a cancellation, refund, withdrawal, charge-reversal, or other consumer right that cannot lawfully be excluded or waived under the laws applicable to you.
If applicable law grants you a mandatory cancellation or withdrawal right, that right will apply notwithstanding the general no-refund policy above.
9. European Economic Area, United Kingdom and Other Mandatory Consumer Rights
If you are a consumer located in the European Economic Area, United Kingdom, or another jurisdiction providing mandatory rights concerning digital content or online purchases, you retain all rights that applicable law does not permit you to waive.
Where legally permitted and presented to you during checkout, we may ask you to expressly request that digital access begin immediately and acknowledge any consequence that immediate performance has on an otherwise applicable statutory withdrawal or cancellation period.
Nothing in these Terms is intended to deprive a consumer of protections that are mandatory under the laws of the consumer’s jurisdiction.
10. California and Other United States Consumers
Consumers located in California and elsewhere in the United States retain any non-waivable rights provided by applicable federal or state law.
Unless expressly disclosed otherwise during checkout, Lifetime Access is a one-time purchase and is not an automatically renewing subscription. Purchasing Lifetime Access does not authorize us to impose recurring subscription charges merely because your access remains active.
Nothing in these Terms limits any right or remedy that cannot lawfully be limited under applicable U.S. federal or state consumer-protection law.
11. Paid Features and Editorial Features
We may offer individuals, businesses, athletes, coaches, teams, sports professionals, brands, professionals, or other persons the opportunity to purchase consideration for a feature, profile, article, interview, placement, promotional feature, or other form of publication or exposure (“Feature Services”).
Purchasing a Feature Service does not make the purchaser an employee, agent, representative, partner, franchisee, contractor, talent represented by us, or member or client of any agency, management company, sports organization, or other professional representation service operated by us.
Unless expressly agreed by us in writing, purchasing a Feature Service does not guarantee employment, athletic opportunities, team placement, recruitment, sponsorships, endorsements, followers, publicity, media attention, sales, revenue, career advancement, verification, partnerships, or any other particular outcome.
We may identify paid, sponsored, promotional, affiliate-supported, or commercially connected content when required by law or when we otherwise determine disclosure is appropriate.
12. Materials Submitted for Features
If you submit photographs, videos, text, names, biographies, logos, trademarks, artwork, social-media content, interviews, quotes, or other materials in connection with a Feature Service or otherwise provide material for publication (“Submitted Materials”), you retain any ownership rights you otherwise hold in those materials, subject to the license granted below.
By submitting Submitted Materials, you represent and warrant that:
- you own the Submitted Materials or have obtained all rights, licenses, permissions, releases, and consents necessary to provide them to us and authorize their use;
- our authorized use of the Submitted Materials will not infringe any copyright, trademark, publicity right, privacy right, contractual right, moral right, or other right of another person;
- you have obtained any necessary photographer, model, property, location, or other releases;
- any person depicted in the Submitted Materials has provided any consent legally required for the intended use;
- if Submitted Materials concern or depict an individual under 18, the individual's parent or legal guardian has authorized the submission and intended publication and you have authority to provide the materials to us;
- the information you provide is not knowingly false, fraudulent, defamatory, or misleading; and
- you have authority to grant the license described in these Terms.
You are responsible for determining whether you possess sufficient rights to materials you submit. Our acceptance of Submitted Materials does not constitute a determination or representation by us that you own or control the necessary rights.
12A. Youth Athletes
Athletes World may permit athletes between the ages of 13 and 17 to participate in eligible applications, interviews, profiles, features, submissions, and other publication-related opportunities.
A parent or legal guardian must authorize a minor's participation and may be required to approve Submitted Materials, execute releases, make purchases, or provide additional consent as appropriate or required by applicable law.
A parent or legal guardian acting on behalf of a minor represents that they have legal authority to provide the applicable authorization, consent, release, or agreement on behalf of that minor.
Individuals under the age of 13 may not submit applications, create accounts, purchase Services, or otherwise provide personal information through the Services.
13. License to Submitted Materials
By submitting Submitted Materials for publication, you grant Burbayne Inc., Athletes World, and their applicable affiliates, service providers, successors, and assigns a worldwide, non-exclusive, royalty-free license to host, store, reproduce, publish, display, distribute, format, crop, resize, adapt for technical or editorial formatting, transmit, and otherwise use the Submitted Materials for purposes reasonably connected with:
- creating and publishing the applicable feature;
- operating and archiving Athletes World;
- displaying the feature on our websites and digital properties;
- promoting the published feature;
- promoting Athletes World and its editorial content;
- displaying excerpts, previews, thumbnails, or links to the feature; and
- maintaining historical or archival copies of published material.
This license does not transfer ownership of your Submitted Materials to us.
14. Editorial Control
We retain editorial control over the Services and, subject to any express written agreement governing a particular paid Feature Service, may determine titles, headlines, formatting, layout, placement, categorization, publication dates, presentation, and reasonable editorial modifications.
We may refuse or remove material that we reasonably believe is unlawful, infringing, fraudulent, deceptive, threatening, defamatory, obscene, harmful, technically unsafe, inconsistent with our publication standards, or otherwise inappropriate for the Services.
Payment for a Feature Service does not require us to publish material that would cause us to violate applicable law or reasonably expose the publication or Burbayne Inc. to legal or security risk.
15. Copyright Claims Concerning Submitted Materials
If a third party claims that Submitted Materials supplied by you infringe their rights, we may remove or disable access to the material while investigating the claim.
We may request evidence demonstrating your right to use the material. Failure to provide reasonably satisfactory evidence may result in permanent removal of the disputed material.
You remain responsible for claims resulting from materials you supplied to us, subject to applicable law and the indemnification provisions below.
16. Our Intellectual Property
Except for Submitted Materials and third-party material, the Services and their content—including articles, editorial material, graphics, logos, mastheads, designs, page layouts, software, databases, photographs, videos, illustrations, trademarks, trade dress, and compilations—are owned by or licensed to us and are protected by applicable copyright, trademark, and other intellectual-property laws.
Your access to the Services does not transfer ownership of any intellectual property to you.
17. Permitted Use
You may access and view the Services for your personal, non-commercial use and may share ordinary links to publicly shareable pages.
Except with our prior written permission or where expressly permitted by applicable law, you may not:
- reproduce, republish, distribute, sell, license, or commercially exploit substantial portions of our content;
- copy or republish complete articles or substantial portions of articles;
- remove copyright, trademark, attribution, disclosure, or proprietary notices;
- systematically download or archive the publication;
- circumvent paywalls, authentication mechanisms, or access restrictions;
- use automated means to scrape, harvest, crawl, extract, or systematically collect protected content except as authorized by us or required by law;
- create or populate a competing publication, database, product, or commercial service using our protected content;
- use our content in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization; or
- attempt to interfere with the security or operation of the Services.
18. Artificial Intelligence and Automated Extraction
Except with our express written permission or to the extent a restriction is prohibited by applicable law, you may not systematically scrape, reproduce, or extract our protected content for the purpose of creating, training, fine-tuning, grounding, evaluating, or improving a commercial artificial-intelligence or machine-learning model, dataset, search product, content-generation system, or competing publication.
This provision does not prohibit ordinary indexing by search engines to the extent permitted by our technical controls or uses independently authorized by applicable law.
19. Affiliate Links
Some content may contain links to products, services, retailers, travel providers, marketplaces, or other third parties from which we may receive compensation.
We may earn a commission or other compensation when you click certain links or make purchases through them. Where required, affiliate relationships or other material commercial connections will be disclosed in connection with the applicable content.
The existence of an affiliate relationship does not make us the seller, manufacturer, supplier, or service provider of the third-party product or service.
20. Advertising and Sponsored Content
The Services may include advertisements, sponsorships, paid placements, branded content, promotional features, gifted products, affiliate relationships, and other commercial arrangements.
Where required by applicable law, we will identify advertising, sponsored content, paid relationships, or other material commercial connections in an appropriate manner.
Advertisers and sponsors are responsible for the products, services, claims, representations, warranties, and offers they provide, subject to any obligations imposed on us by applicable law.
21. Editorial Independence and Opinions
Views and opinions expressed by writers, interviewees, contributors, photographers, athletes, coaches, featured individuals, advertisers, or other third parties do not necessarily represent the views of Athletes World or Burbayne Inc.
Editorial content may include subjective opinions, commentary, reviews, criticism, recommendations, forecasts, or assessments.
We do not guarantee that every piece of published information will remain complete, accurate, current, or error-free. We may correct, update, modify, clarify, or remove content at any time.
22. No Professional Advice
Content provided through the Services is for general informational and editorial purposes only.
Nothing published by Athletes World constitutes legal, medical, financial, investment, tax, employment, immigration, mental-health, nutritional, or other regulated professional advice unless expressly stated otherwise and provided by an appropriately qualified professional.
You should obtain appropriate professional advice when making decisions requiring professional expertise.
23. Athletics and Career Information
References to athletics, sports, training, nutrition, fitness, teams, coaches, recruitment, sponsorships, endorsements, competitions, careers, compensation, opportunities, or industry practices are provided for editorial or informational purposes unless expressly identified otherwise.
Athletes World is not, merely by operating the publication or publishing a feature, acting as a sports agent, talent agent, manager, recruiter, coach, team, league, governing body, employment agency, or representative for featured persons or readers.
Being featured in the publication does not constitute professional representation, athletic certification, verification of ability or experience, team selection, recruitment, sponsorship, endorsement, or a promise of employment or paid opportunities.
24. Third-Party Websites and Services
The Services may contain links to websites, social-media platforms, retailers, advertisers, payment providers, products, services, and other resources operated by third parties.
We do not control those third parties and are not responsible for their websites, availability, security, privacy practices, terms, products, services, shipping, customer service, representations, or conduct.
Your dealings with a third party are between you and that third party, subject to any rights you may have under applicable law.
25. Prohibited Conduct
You agree not to:
- use the Services for unlawful or fraudulent purposes;
- attempt to gain unauthorized access to the Services or another person's access;
- share, sell, publish, or commercially distribute authentication links;
- circumvent technological restrictions or access controls;
- introduce malware, malicious code, or harmful technology;
- interfere with the normal operation or security of the Services;
- impersonate another person or misrepresent your affiliation with a person or organization;
- submit material you know you do not have permission to use;
- use the Services to violate another person's intellectual-property, privacy, publicity, or other legal rights; or
- use the Services in a manner that violates these Terms.
26. Suspension and Termination
We may suspend or terminate access when reasonably necessary because of fraud, unauthorized resale or distribution of access, material violations of these Terms, unlawful activity, threats to security, abusive conduct directed toward our systems or personnel, or other material misuse of the Services.
Where reasonably appropriate, we may provide an opportunity to correct a violation before permanent termination. We are not required to do so in cases involving fraud, illegality, serious security risks, or deliberate circumvention of access controls.
Termination for your material breach of these Terms does not create a right to a refund except where required by applicable law.
27. Availability and Changes to the Services
We do not guarantee uninterrupted or error-free availability of the Services.
The Services may occasionally be unavailable because of maintenance, hosting failures, internet outages, cyberattacks, software errors, third-party service failures, force majeure events, or circumstances outside our reasonable control.
We may update, redesign, migrate, replace, or otherwise modify the Services and their underlying technology.
28. Discontinuation of the Publication
We reserve the right to discontinue Athletes World or the Services in the future.
If Athletes World permanently ceases publication or the applicable Lifetime Access service permanently ceases operation, Lifetime Access may end. The discontinuation of the publication does not, by itself, create a refund entitlement except where a refund or other remedy is required by applicable law.
Nothing in these Terms represents or guarantees that the publication will operate indefinitely.
29. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
WE DISCLAIM WARRANTIES, REPRESENTATIONS, AND CONDITIONS NOT EXPRESSLY PROVIDED IN THESE TERMS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY, TO THE EXTENT SUCH WARRANTIES OR CONDITIONS MAY LAWFULLY BE DISCLAIMED.
Some jurisdictions do not permit the exclusion of certain warranties or statutory guarantees. In those jurisdictions, this section applies only to the maximum extent permitted by law.
30. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BURBAYNE INC., ATHLETES WORLD, AND THEIR APPLICABLE AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, OR LOSS OF GOODWILL ARISING FROM OR RELATING TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO A PARTICULAR PAID SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THAT SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR, IN THE CASE OF A ONE-TIME LIFETIME ACCESS PURCHASE, THE AMOUNT YOU PAID FOR THAT PURCHASE.
These limitations do not apply to liability that applicable law does not permit us to exclude or limit.
31. Indemnification
To the extent permitted by applicable law, if you submit materials, purchase a Feature Service, use the Services commercially, or materially violate these Terms, you agree to indemnify and hold harmless Burbayne Inc., Athletes World, and their applicable affiliates, directors, officers, employees, contractors, and agents from third-party claims, damages, liabilities, judgments, costs, and reasonable legal fees arising from:
- Submitted Materials provided by you;
- your infringement or alleged infringement of another person's intellectual-property, privacy, publicity, or contractual rights;
- your material violation of these Terms;
- fraudulent or unlawful conduct by you; or
- representations or warranties made by you that are materially false.
This section does not require you to indemnify us for liability resulting solely from our own unlawful conduct where such indemnification is prohibited by applicable law.
32. Copyright and Intellectual-Property Complaints
We respect intellectual-property rights. If you believe material appearing through the Services infringes rights you own or are authorized to enforce, please contact us at [email protected].
Your notice should identify the protected work, the allegedly infringing material, where the material appears, your contact information, the basis for your claim, and sufficient information for us to reasonably evaluate the complaint.
We may remove or restrict access to disputed material while reviewing a complaint.
33. Privacy
Your use of the Services is also subject to our Privacy Policy, which describes how personal information is collected, used, disclosed, retained, and otherwise handled.
Where these Terms and the Privacy Policy address different subjects, each document applies to its respective subject matter.
34. Electronic Communications
By purchasing or using the Services, you agree that transactional communications relating to your purchase, access, authentication, security, legal notices, and operation of the Services may be delivered electronically, including by email.
Marketing communications are subject to applicable consent, unsubscribe, and electronic-marketing requirements and are distinct from communications reasonably necessary to provide a service you requested.
35. International Use
The Services may be accessible internationally. We do not represent that every aspect of the Services is appropriate or legally available in every jurisdiction.
You are responsible for complying with laws applicable to your use of the Services in your jurisdiction.
Nothing in these Terms is intended to eliminate mandatory consumer protections applicable to you based on your place of residence where those protections cannot lawfully be waived by contract.
36. Governing Law
Except where mandatory law provides otherwise, these Terms and disputes arising from or relating to them or the Services are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
37. Jurisdiction
Except where applicable consumer law gives you a non-waivable right to bring proceedings elsewhere, you agree that disputes arising from or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Nova Scotia, Canada.
If the laws applicable to you permit you to bring a consumer claim in the courts or tribunals of your place of residence notwithstanding this provision, nothing in these Terms eliminates that right.
38. Mandatory Consumer Protections
These Terms are intended to apply to users in Canada, the United States, the European Economic Area, the United Kingdom, and other jurisdictions in which the Services are offered.
Consumer-protection laws differ between jurisdictions. If a provision of these Terms conflicts with a mandatory law applicable to you that cannot lawfully be waived or modified by contract, the mandatory law will control only to the extent of that conflict.
The remainder of these Terms will continue to apply.
39. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Services, our business, technology, legal requirements, or commercial practices.
The “Last Updated” date at the beginning of these Terms identifies when they were most recently revised.
Where required by applicable law, we will provide additional notice of material changes.
Changes will not retroactively eliminate vested rights that applicable law or an existing completed transaction prevents us from changing.
40. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent.
To the extent permitted by applicable law, we may assign or transfer these Terms or the operation of the Services in connection with a corporate reorganization, financing, merger, acquisition, sale, transfer of the publication, transfer of assets, or similar business transaction, provided that applicable obligations relating to existing paid access remain subject to these Terms and applicable law.
41. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
42. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, and the remaining provisions will remain in effect.
43. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly presented and accepted in connection with a particular purchase or Service, constitute the agreement between you and us concerning your use of the Services.
If specific terms presented for a particular paid product conflict with these general Terms, the specific terms will control with respect to that product to the extent of the conflict.
